I wish to be enrolled as a Participant or Independent Subscriber with full access (includes active listings, off market listings, comparable and statistical information, tax access, rosters, and bulletin board) in the Greater El Paso Association of REALTORS® Multiple Listing Service, Inc. (MLS, Inc.), effective the date requested on this application.

 I have read and understand, and agree to abide by the Bylaws of the Greater El Paso Association of REALTORS® (GEPAR) and of MLS, including those provisions dealing with charge account deposits, suspension and termination for non-payment of dues, fees, other assessments, service fees and charges, and resignation.

 I understand and agree that accounts not paid within thirty (30) days of the billing date will be charged interest at a rate set by the Board of Directors, not to exceed the legal maximum set by law. I further understand and agree at this time, the rate is l.5% per month.

 I have also read and understand the Code of Ethics of the National Association of REALTORS® and the Rules and Regulations of the MLS, and I agree to abide by the Rules and Regulations and the Code of Ethics, including the membership duty to arbitrate disputes, and the requirements of confidentiality of MLS information. 

I further agree to instruct any and all subscribers, as defined by the Rules and Regulations, and/or associates and employees I may have now, or in the future, to be thoroughly familiar with, and abide by, the Code of Ethics and Rules and Regulations. In addition to monthly access fees and annual renewal fees, as determined by the MLS Board, applicant agrees to pay a $200 initial participation fee as outlined in the Rules and Regulations of the Greater El Paso Association of REALTORS® Multiple Listing Service, Inc. The MLS initial participation fee is collected solely for the purpose of augmenting MLS operational financing, training, and system development, and will not be refundable once an applicant has been granted membership. The initial participation fee is nontransferable. AS A PARTICIPANT, I AGREE TO INDEMNIFY AND HOLD HARMLESS MLS FROM ANY LOSS, DAMAGE OR INJURY TO MLS SYSTEM AND FROM ANY CLAIMS OF THIRD PARTIES, ARISING FROM PARTICIPANT’S ACCESS TO THE MLS SYSTEM OR ANY OF ITS ACTIVITIES AS AN MLS PARTICIPANT, OR THOSE OF ITS AFFILIATED MLS SUBSCRIBERS, EVEN IF SAID LOSS, DAMAGE, INJURY OR CLAIM IS ALLEGED OR PROVEN TO HAVE BEEN CAUSED BY THE NEGLIGENCE OF MLS.
